ProHomie Terms of Use
Effective Date: September 10, 2026 · Last Updated: September 10, 2026
These Terms of Use (“Terms”) constitute a legally binding agreement between you (“User,” “Customer,” “Professional,” “you,” or “your”) and ProHomie LLC, including its affiliates, subsidiaries, successors, and assigns (“ProHomie,” “we,” “us,” or “our”).
These Terms govern your access to and use of the ProHomie mobile applications, including the ProHomie Customer App and ProHomie Partner App, websites, software, communications systems, payment functionality, artificial-intelligence features, and other products and services made available by ProHomie (collectively, the “Platform”).
IMPORTANT: THESE TERMS CONTAIN PROVISIONS REGARDING BINDING INDIVIDUAL ARBITRATION, A CLASS-ACTION WAIVER, AND A JURY-TRIAL WAIVER. PLEASE READ THESE TERMS CAREFULLY.
By creating an account, clicking “I Agree,” accessing the Platform, requesting services, offering services, or otherwise using ProHomie, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy.
If you do not agree, you may not use the Platform.
1. ProHomie Platform
ProHomie operates a technology marketplace designed to connect individuals and businesses seeking services (“Customers”) with independent professionals and businesses offering services (“Professionals”).
Services available through ProHomie may include, without limitation, home improvement, maintenance, cleaning, moving, landscaping, electrical, plumbing, HVAC, handyman services, appliance services, painting, installation, repair, technology services, professional services, and other service categories offered through the Platform (“Professional Services”).
Unless ProHomie expressly states otherwise for a particular service, ProHomie does not itself perform Professional Services offered by independent Professionals.
ProHomie provides technology that may enable Customers and Professionals to discover one another, communicate, request or provide estimates, schedule appointments, exchange information, make or receive payments, submit reviews, and otherwise facilitate service transactions.
The agreement for the actual Professional Services is between the Customer and the Professional.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to create a ProHomie account or use transaction-related portions of the Platform.
By using ProHomie, you represent that the information you provide is accurate and complete, you have legal authority to enter into these Terms, you will comply with applicable federal, state, and local laws, and you are not prohibited by law from using the Platform.
3. User Accounts
Certain Platform features require an account.
You agree to provide accurate, current, and complete information and to update that information when necessary.
You are responsible for maintaining the confidentiality and security of your login credentials and for activity conducted through your account.
You may not impersonate another person, create fraudulent accounts, transfer your account without authorization, or use another person's account without permission.
You must promptly notify ProHomie if you believe your account has been compromised.
ProHomie may require identity, telephone, email, payment, or other reasonable verification procedures.
4. Customers
Customers may use ProHomie to search for Professionals, submit service requests, receive estimates or quotes, communicate with Professionals, schedule services, make payments where available, and provide reviews.
Customers are responsible for accurately describing requested work, providing necessary project information, confirming pricing and scope before work begins, providing safe and lawful access to service locations, and paying amounts properly agreed upon with Professionals.
Customers are responsible for determining whether a particular Professional is appropriate for their project.
5. Professionals and ProHomie Partner
Professionals may use ProHomie Partner to create profiles, identify service categories, receive potential customer opportunities, communicate with Customers, provide estimates or quotes, schedule work, manage projects, and receive payments through available Platform features.
Every Professional represents and warrants that the Professional and anyone performing services on the Professional's behalf:
- Has the experience, skills and qualifications reasonably necessary to perform the services offered.
- Possesses all licenses, registrations, permits, certifications, bonds and insurance required by applicable law.
- Will maintain required qualifications while using ProHomie.
- Will comply with applicable federal, state and local laws.
- Will perform services safely and professionally.
- Will accurately represent qualifications, experience, availability, pricing, business information, licenses and insurance.
- Will not engage in fraudulent, deceptive, discriminatory, threatening, abusive or unlawful conduct.
- Will be responsible for personnel, subcontractors, tools, equipment, materials, taxes, insurance and other business expenses associated with providing Professional Services.
ProHomie may request evidence supporting a Professional's qualifications.
6. Independent Professionals
Professionals using ProHomie are independent businesses or independent service providers and are not employees of ProHomie solely because they use the Platform.
Unless otherwise expressly agreed in writing, ProHomie does not employ Professionals and does not establish their schedules, supervise the manner in which Professional Services are performed, provide their tools or equipment, or guarantee any minimum amount of work.
Professionals generally determine which opportunities to accept, what services to provide, their availability and, subject to applicable Platform features and law, their pricing.
Nothing in these Terms creates an employment, partnership, joint venture, franchise or agency relationship between ProHomie and an independent Professional.
7. Licenses, Insurance and Credentials
Certain services may require licenses, permits, insurance, bonding, registrations or certifications.
Professionals are responsible for satisfying requirements applicable to their services and locations.
ProHomie may display information regarding licenses, credentials, insurance or verification status. Such information does not constitute a guarantee by ProHomie that a Professional is qualified, licensed, insured, trustworthy or suitable for a particular project.
Customers should independently verify credentials where appropriate, especially for regulated work.
8. Identity Verification and Background Checks
To promote trust and safety, ProHomie may use third-party service providers to conduct identity verification, criminal background checks, sex-offender registry searches, professional-license verification, business verification, fraud screening, or other legally permitted checks.
Professionals authorize ProHomie and its authorized providers to obtain and use information reasonably necessary to perform permitted verification procedures, subject to applicable law and any additional authorization required by law.
A background check or verification does not guarantee that a Professional is safe, trustworthy, competent, licensed, insured, or appropriate for a particular job.
A Professional account representing a company may include employees, contractors, subcontractors or other workers who have not individually undergone the same verification process.
Where required by law, ProHomie will provide applicable notices, authorizations and procedures concerning consumer reports and adverse actions.
ProHomie may deny, restrict, suspend or terminate Professional access based on verification results or failure to cooperate with verification requirements, subject to applicable law.
9. Matching, Search and AI Recommendations
ProHomie may use algorithms and artificial intelligence to match Customers with Professionals.
Matching factors may include location, service category, availability, pricing information, reviews, responsiveness, credentials, experience, customer preferences and Platform activity.
Search placement, ranking or recommendation does not constitute an endorsement or guarantee.
ProHomie does not guarantee that Customers will receive responses or that Professionals will receive leads, jobs, bookings, revenue or any particular amount of business.
10. Estimates and Quotes
Professionals may provide estimates or quotes through ProHomie.
Unless expressly identified as a guaranteed price, estimates may change based on actual project conditions, labor requirements, materials, additional Customer requests, taxes, permits or other factors.
Customers and Professionals should agree upon scope, price, payment schedule, materials, timing, warranties, permits and significant changes before work begins.
ProHomie is generally not a party to the service contract between a Customer and Professional.
11. ProHomie Fees
ProHomie may charge Customers or Professionals fees for Platform features, subscriptions, leads, bookings, transactions, payment processing, advertising, promotions, premium placement or other services.
Applicable fees will be disclosed through the Platform or applicable subscription plan before being charged.
ProHomie may introduce or modify fees and pricing structures from time to time subject to applicable law and notice requirements.
12. Payments
ProHomie may enable Customers to pay Professionals through authorized payment processors.
By using Platform payment functionality, Users authorize ProHomie and its payment-processing partners to process applicable charges, fees, refunds, adjustments and payouts.
Professionals are responsible for providing accurate payment, banking and tax information.
ProHomie may delay or withhold transactions where reasonably necessary to investigate suspected fraud, chargebacks, disputes, illegal activity or violations of these Terms, subject to applicable law.
13. Taxes
Professionals are responsible for determining and satisfying tax obligations associated with Professional Services and income earned through ProHomie, except where ProHomie is legally required to collect, report or remit taxes.
ProHomie may collect tax information and issue required tax documents.
14. Cancellations and Refunds
Cancellation and refund eligibility may depend on the Professional, service category, timing of cancellation, applicable ProHomie policy and circumstances of the transaction.
Applicable cancellation fees or refund policies should be disclosed through the Platform.
Unless otherwise required by law or expressly guaranteed by ProHomie, ProHomie does not guarantee refunds for disputes concerning services performed by independent Professionals.
15. Ratings and Reviews
Customers may submit ratings, reviews, photographs and other feedback regarding Professionals.
Reviews must reflect genuine experiences and may not contain knowingly false information, threats, harassment, unlawful discrimination, confidential information or content violating another person's rights.
Professionals may not purchase or create fake reviews, review themselves, improperly incentivize positive reviews, threaten Customers regarding reviews or otherwise manipulate the ProHomie rating system.
ProHomie reserves the right to investigate, restrict or remove content violating applicable policies or law.
16. User Content
Users may submit photographs, videos, text, project descriptions, messages, business information, reviews, estimates, portfolios and other content (“User Content”).
Users retain ownership of their User Content.
By submitting User Content, you grant ProHomie a worldwide, non-exclusive, royalty-free, transferable and sublicensable license to host, store, reproduce, display, distribute, format and otherwise use the content as reasonably necessary to operate, improve, protect, market and promote ProHomie, subject to applicable law and the ProHomie Privacy Policy.
17. Communications
ProHomie may provide in-app messaging, calling, email, SMS, push notifications, automated assistants and other communication tools.
Where permitted by law and appropriately disclosed, communications conducted through Platform systems may be monitored, recorded, analyzed or processed for safety, fraud prevention, dispute resolution, customer support, quality assurance and Platform improvement.
Marketing communications will comply with applicable consent and opt-out requirements.
18. ProHomie AI Features
ProHomie may provide AI-powered search, matching, recommendations, communications, scheduling, estimates, customer assistance, Professional assistance and other automated functionality.
AI-generated information can contain errors and should not be considered legal, financial, engineering, medical, safety or other professional advice.
Users remain responsible for reviewing important information and making their own decisions regarding Professional Services.
19. Safety
Customers and Professionals must exercise reasonable precautions when interacting or meeting.
Users should report suspicious, threatening, fraudulent, dangerous or unlawful conduct to ProHomie and, where appropriate, law enforcement or emergency services.
Customers should independently evaluate Professionals and should not rely exclusively on profiles, ratings, badges, background checks or Platform recommendations where personal safety or significant property risks are involved.
20. Prohibited Conduct
Users may not provide false information, impersonate another person or business, engage in fraud, manipulate payments or reviews, harass or threaten Users, unlawfully discriminate, offer unlawful services, violate licensing requirements, introduce malicious software, interfere with Platform security, scrape Platform data without authorization, misuse personal information, circumvent legitimate ProHomie fees, or otherwise use the Platform in a manner that harms ProHomie or its Users.
21. Intellectual Property
The ProHomie name, logo, trademarks, software, interfaces, designs, algorithms, databases, graphics, features, technology and other proprietary Platform materials are owned by or licensed to ProHomie and protected by applicable intellectual-property laws.
These Terms do not transfer ownership of ProHomie's intellectual property.
ProHomie grants Users a limited, revocable, non-exclusive and non-transferable license to use the Platform for its intended purposes, subject to these Terms.
22. Third-Party Services
ProHomie may integrate with third-party providers for payment processing, background checks, identity verification, mapping, communications, analytics, cloud services, insurance, financing and other functionality.
Third-party services may be governed by their own terms and privacy policies.
23. Customer-Professional Disputes
Customers and Professionals should first attempt to resolve disagreements directly and in good faith.
ProHomie may provide customer-support or dispute-resolution assistance but is generally not obligated to resolve disputes concerning quality, pricing, scope, completion, safety or performance of Professional Services.
ProHomie's involvement in a dispute does not make ProHomie a party to the underlying service agreement.
24. No Guarantee of Professional Services
To the fullest extent permitted by law, ProHomie does not guarantee the identity or conduct of every User, quality or safety of Professional Services, project completion, Customer payment, accuracy of quotes, accuracy of User reviews, suitability of a Professional, or any particular business result.
Any ProHomie Guarantee or similar protection program offered in the future will be governed by separate terms applicable to that program.
25. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PROHOMIE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.”
PROHOMIE DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY AND AVAILABILITY TO THE EXTENT PERMITTED BY LAW.
Nothing in these Terms excludes rights or warranties that cannot legally be excluded.
26. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROHOMIE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, BUSINESS, DATA OR GOODWILL ARISING FROM THE PLATFORM OR PROFESSIONAL SERVICES.
To the extent permitted by law, ProHomie's aggregate liability arising from these Terms or use of the Platform will not exceed the greater of amounts paid directly to ProHomie by the User during the six months preceding the event giving rise to the claim or $100.
These limitations do not apply where prohibited by law.
27. Indemnification
To the extent permitted by law, you agree to defend, indemnify and hold harmless ProHomie and its affiliates, directors, officers, employees, agents and service providers against claims, damages, liabilities, losses, costs and reasonable attorneys' fees arising from your violation of these Terms, User Content, violation of law, infringement of another person's rights, or Professional Services provided by you or on your behalf.
28. Account Suspension and Termination
ProHomie may investigate suspected violations and may warn, restrict, suspend, deactivate or terminate accounts where reasonably necessary to protect Users, address fraud or safety concerns, comply with law or enforce these Terms.
Serious safety, fraud, criminal or legal concerns may result in immediate action.
Users may request account closure subject to outstanding transactions and applicable legal or record-retention obligations.
29. Arbitration Agreement
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Except where prohibited by law and subject to eligible small-claims matters and certain requests for injunctive relief, you and ProHomie agree that disputes arising from or relating to these Terms, the Platform, or your relationship with ProHomie will be resolved through binding individual arbitration rather than court litigation.
Before arbitration, the complaining party must provide written notice describing the dispute and requested relief and provide a reasonable opportunity for informal resolution.
Arbitration will be administered by a nationally recognized arbitration provider under applicable consumer or commercial arbitration rules.
The Federal Arbitration Act will govern interpretation and enforcement of this arbitration provision where applicable.
Nothing in these Terms prevents either party from bringing an eligible individual claim in small claims court.
30. Class-Action and Jury-Trial Waiver
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND PROHOMIE AGREE THAT CLAIMS WILL BE BROUGHT ONLY ON AN INDIVIDUAL BASIS AND NOT AS PART OF A CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE ACTION.
You and ProHomie waive the right to a jury trial for claims subject to arbitration.
31. Governing Law
Except where federal law applies or applicable law requires otherwise, these Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
For disputes not subject to arbitration, the parties consent to the jurisdiction of appropriate state or federal courts located in Collin County, Texas, unless applicable law requires another venue.
32. Changes to These Terms
ProHomie may periodically update these Terms.
When material changes are made, ProHomie may provide notice through the Platform, email, website or another legally appropriate method.
The “Last Updated” date identifies the current version.
33. Privacy
Use of ProHomie is also governed by the ProHomie Privacy Policy, which explains how ProHomie collects, uses, shares, stores and protects personal information.
Additional notices may apply to background checks, identity verification, payment processing, location services, artificial intelligence and communications.
34. Electronic Communications
You consent to receive legally permitted notices and communications electronically, including by email, SMS, push notification and in-app notification.
Electronic notices may satisfy legal requirements that communications be provided in writing where permitted by law.
35. App Store Terms
If you download ProHomie or ProHomie Partner through the Apple App Store, Google Play or another marketplace, additional terms imposed by that provider may apply.
36. Severability
If any provision of these Terms is determined to be invalid or unenforceable, remaining provisions will continue in effect to the maximum extent permitted by law.
37. No Waiver
ProHomie's failure to enforce any provision does not waive its right to enforce that provision later.
38. Assignment
Users may not assign or transfer these Terms without ProHomie's prior written consent.
ProHomie may assign these Terms in connection with a merger, acquisition, financing, restructuring, sale of assets or other business transaction, subject to applicable law.
39. Entire Agreement
These Terms, together with the ProHomie Privacy Policy and additional policies or terms expressly incorporated into them, constitute the agreement between you and ProHomie regarding use of the Platform.
